Sentencing is set in March for a Danville man convicted Friday (January 25, 2019) in a home invasion in which a 90-year-old man was beaten. A Vermilion County Circuit Court jury found 28-year-old Cole J. R. Huber guilty on charges of home invasion, residential burglary, aggravated battery with great bodily harm to a person over 60, and aggravated battery to a person over 60. Huber’s last known address was on Green Acres Road, Danville.
Vermilion County State’s Attorney Jacqueline Lacy says evidence presented during a four day trial indicated Huber broke into the residence of a 90-year-old Danville man and battered him causing significant physical injuries. She noted the defendant’s DNA and palm prints were found at the scene.
Huber will be sentenced by Circuit Judge Thomas O’Shaughnessy who presided over the trial. Lacy told VermilionCountyFirst.com News that Home Invasion is a class X felony and, based upon the victim’s age, carries a sentencing range of 6 to 60 years in the Illinois Department of Corrections. Huber will be required to serve 85-percent of the sentence if the court makes a finding of great bodily harm.
